This NEWS FLASH is intended to advise JCC clients that the expired EPA NPDES General Permit Nos. GMG280000 and GMG290000 are expected to be tentatively published during the first week of October 2004. MORE NEWS TO FOLLOW.

EPA REGION 6 - NPDES GENERAL PERMIT GMG290000
OCS FEDERAL WATERS, WESTERN GULF OF MEXICO

POINTS TO CONSIDER:
  • Permit is proposed for a 3-year term (instead of the normal 5 years) to allow for acquisition of data to prepare the Ocean Discharge Criteria Evaluation (ODCE) under CWA 403(c) for produced water impacts to hypoxia.
  • The permit will contain a requirement for permittees to participate in an industry-wide produced water characterization study to analyze the oxygen demanding constituents and nutrients in produced water that may be contributing to near-field and regional hypoxic conditions.

POINTS TO CONSIDER:
  • EPA is working with MMS to develop an MOU for offshore inspections. EPA wants to collect samples of waste water for analyses and since MMS is not set up to do sampling, EPA will plan to go offshore once per year to collect samples for analysis.
